Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of your agreement with Andri.ai as detailed in our Terms of Service ("Terms"). Capitalized terms used but not defined in this AUP have the meanings set forth in the Terms. By using the Andri.ai Platform ("Platform" or "Services"), you agree to comply with this AUP and ensure that anyone using the Services on your behalf also complies with it.

1. Prohibited Activities

You agree not to, and not to direct or allow any third parties to, use Andri.ai in any of the following prohibited ways:

• Violation of Rights: To violate, or encourage the violation of, the legal rights (including data protection, privacy, and intellectual property rights) of others.
• Illegal or Unethical Activities: To engage in, promote, or encourage any form of illegal, unethical, or malicious activity, or to facilitate others in doing so.
• Unlawful or Deceptive Purposes: For any unlawful, invasive, infringing, defamatory, fraudulent, or deceptive purposes.
• Misrepresentation of AI-Generated Output: To misrepresent or affirmatively claim that any AI-generated output ("Output") is entirely human-generated without adequately disclosing its AI-generated nature, where required by law or ethical guidelines.
• Malware Distribution: To intentionally distribute or facilitate the distribution of malware, viruses, worms, Trojan horses, corrupted files, or other items of a destructive or deceptive nature.
• Service Disruption: To interfere with or disrupt the use of the Services, or the infrastructure and equipment used to provide the Services, by Andri.ai or its customers.
• Security Circumvention: To attempt to disable, interfere with, or circumvent any security features or aspects of the Services.
• Violation of Law or Terms: To use the Services in violation of applicable laws, regulations, or the Terms.
• Reverse Engineering: To attempt to reverse-engineer, decompile, or derive the source code, algorithms, or architecture of the Andri.ai Platform or its underlying technology.
• Competitive Use: To use the Services to build, develop, or improve similar or competitive products, features, or services to Andri.ai, its subcontractors, or partners.
• Harm to Reputation or Operations: To use the Services in any way that would adversely impact or undermine the reputation, operation, or integrity of Andri.ai, its customers, or any third parties.

2. Prohibited Content

In addition to the above, you may not use Andri.ai to create, store, publish, or share content that:

• Hate Speech or Harassment: Promotes or condones violence, hatred, harassment, or abuse against any individual or group.
• Child Exploitation: Depicts or promotes sexual content involving minors or any content that exploits or endangers minors.
• Personal Data Misuse: Violates data protection laws or regulations, including the unauthorized sharing or collection of personal data (e.g., credit card information, national identification numbers, or other private details) without the data subject's consent or lawful basis.
• Terrorism or Extremism: Promotes or supports extremist ideologies, terrorism, or violence.
• Intellectual Property Infringement: Violates or promotes the violation of intellectual property rights, including unauthorized sharing of copyrighted materials or trade secrets.
• Deceptive or Misinformative Content: Intentionally spreads misinformation or disinformation that could cause harm to the public, especially in a legal context.

3. EU Data Protection & Privacy Obligations

As Andri.ai operates in the European Union ("EU") and processes personal data in connection with providing the Services:

• GDPR Compliance: You must ensure that your collection, use, and sharing of personal data through the Platform comply with the EU General Data Protection Regulation ("GDPR") and other applicable EU data protection laws.
• Lawful Processing: You warrant and represent that you have a valid legal basis (e.g., consent, contract, legitimate interest) for processing any personal data using Andri.ai.
• Data Minimization: You agree to only upload or process personal data that is strictly necessary for your use of the Platform and to implement appropriate technical and organizational measures to safeguard such data.
• Data Subject Rights: You must respond to and comply with any valid data subject requests, including access, rectification, erasure, and objection requests, in accordance with GDPR requirements.

4. Fair Usage & Resource Abuse

• Excessive Usage: You will not use the Services in a manner that unreasonably consumes a disproportionate amount of system resources or that may degrade service performance for other users.
• Automated Access: You may not use any automated means to access or query the Platform in a manner that sends more requests than a human could reasonably produce in the same period by using a conventional online web browser, unless expressly permitted by Andri.ai.

5. Enforcement & Remedies

We reserve the right, in our sole discretion, to determine whether any use of the Services violates this AUP. If Andri.ai believes you or your users are in breach of this AUP, we may suspend or terminate your access to the Services, remove or disable any non-compliant content, or take any other action we deem appropriate without prior notice. In cases of repeated or severe violations, we reserve the right to report such conduct to the appropriate authorities.

6. Reporting Violations

If you become aware of any violation of this AUP, please promptly notify us at legal@andri.ai. We will investigate and take appropriate action, in our sole discretion.

7. Changes to this AUP

We may modify this AUP from time to time by posting a revised version on our website. The revised version will be effective as of the time it is posted. Your continued use of the Platform after any changes to this AUP become effective constitutes your acceptance of those changes.

By using the Andri.ai Platform, you acknowledge that you have read, understood, and agree to abide by all the terms and conditions outlined in this AUP.
